  • Continental’s appeal was tossed last week on different basis

Auto parts supplier Continental Automotive Systems Inc. lost its bid to revive an antitrust lawsuit against several holders of patents for key telecommunications technology in vehicles and their licensing agent, Avanci LLC, as the Fifth Circuit affirmed a Texas federal court’s dismissal of Continental’s claims.

Last week, the three-judge panel of the US Court of Appeals for the Fifth Circuit—which in February tossed Continental’s appeal of the dismissal—said it would treat Continental’s request for a rehearing en banc as a petition for a panel rehearing. The panel then granted that request and withdrew its February opinion.
